Booking & Stay Terms and Conditions

1. About These Terms

The Woodlots at Croft Lake is owned and operated by Orange Door Properties Inc. ("The Woodlots," "we," "us," or "our").

These Booking & Stay Terms and Conditions ("Terms") apply to direct reservations and stays at The Woodlots at Croft Lake. By making a reservation, the person making the booking ("Guest") confirms that they have read, understood and agreed to these Terms and that they are authorized to accept them on behalf of all members of their party.

These Terms should be read together with the applicable reservation details, cancellation policy, House Rules, Guest Information Guide, liability waiver and Privacy Policy. Together, these documents form part of the agreement governing the reservation and stay.


2. Online Booking and Acceptance

Before completing a direct reservation, the Guest will be provided with the material terms of the reservation, including the accommodation being booked, applicable charges, cancellation policy and material conditions of booking, and will be given an opportunity to review and accept the reservation.

The Guest will be provided an express opportunity to accept or decline the booking agreement and to correct errors before completing the reservation.

A confirmation and/or copy of the applicable reservation agreement will be provided electronically following booking in a form the Guest can retain.


3. Booking Eligibility and Guest Information

The person making the reservation must be legally capable of entering into a binding agreement and must provide complete and accurate booking, contact and payment information.

The primary Guest must be the person named on the reservation and must be present at the property for the duration of the stay unless otherwise approved by The Woodlots in writing.

Reservations may not be transferred or assigned to another person without prior written approval from The Woodlots.

Providing false, misleading or materially incomplete booking or guest information may result in cancellation of the reservation or termination of the stay.


4. Maximum Occupancy and Visitors

Maximum overnight occupancy is four (4) registered guests.

Only registered guests are permitted on the property unless prior approval has been obtained from The Woodlots.

The primary Guest is responsible for the conduct of all members of the rental party and any approved visitors and for ensuring that all such persons comply with these Terms, the House Rules, safety instructions and applicable laws.


5. Rates, Taxes, Payment and Minimum Stay

Unless otherwise stated, all rates are quoted in Canadian dollars.

Applicable taxes and any booking, processing or other charges will be disclosed through the reservation process before the booking is completed.

Payment in full is required at the time of booking unless different payment terms are expressly provided through an authorized booking platform.

All direct-booking payments must be processed through The Woodlots or an authorized booking or payment provider. Guests should not send payment through any unauthorized method.

Minimum-stay requirements vary by date and season and will be displayed at the time of booking.


6. Cancellation and Refunds

Unless different cancellation terms are expressly identified on the reservation, reservations cancelled at least fifteen (15) days before the scheduled arrival date are eligible for a 100% refund of the accommodation charge, less any non-refundable booking or processing fees.

Reservations cancelled at least seven (7) days, but fewer than fifteen (15) days, before the scheduled arrival date are eligible for a 50% refund of the accommodation charge, less any non-refundable booking or processing fees.

Reservations cancelled fewer than seven (7) days before the scheduled arrival date are non-refundable.

The cancellation date is the date on which The Woodlots receives the Guest's cancellation request.

Guests are encouraged to obtain appropriate travel insurance to protect against unforeseen events, illness, transportation disruption, weather or other circumstances that may affect their trip.

Where a reservation is made through a third-party booking platform, that platform's applicable cancellation and refund rules may also apply.

Nothing in this section limits any cancellation or refund right that the Guest may have under applicable law.


7. Mandatory Guest Verification and Liability Waiver

Completion of The Woodlots' required guest verification process and liability waiver are conditions of the reservation and occupancy of the property.

The primary Guest may be required to complete identity and guest verification through The Woodlots' third-party verification provider, Truvi, including provision of government-issued identification or other information reasonably required to verify the reservation.

The primary Guest must also complete and execute any liability waiver required by The Woodlots.

These requirements are disclosed during the booking process and must be completed by the deadline communicated to the Guest and, in all cases, before check-in.

If the Guest fails or refuses to complete the required verification or liability waiver by the applicable deadline, access to the property may be withheld, check-in credentials may not be issued, and The Woodlots may cancel the reservation.

Any cancellation resulting from the Guest's failure or refusal to satisfy these disclosed pre-arrival requirements will be treated as a Guest cancellation occurring on the date of cancellation and will be subject to the cancellation policy applicable to the reservation.

The Guest is not entitled to a refund solely because the Guest failed or refused to complete a required verification, identification or waiver requirement, except where otherwise required by applicable law.

The Woodlots may, in its discretion, provide additional time to satisfy an outstanding requirement. Providing additional time or making an exception in one instance does not waive the requirement or require the same exception for another reservation.

Information processed by third-party verification providers is subject to their applicable privacy practices and The Woodlots' Privacy Policy.


8. Damage Pre-Authorization and Guest Responsibility

A pre-authorization hold of up to $500 may be placed on the payment card associated with the reservation up to forty-eight (48) hours before check-in. Successful authorization may be required before access to the property is provided.

A pre-authorization is not ordinarily a completed charge. Following check-out, the hold will be released provided that no amount is reasonably required in connection with damage to the property, furnishings, equipment or amenities; missing property; excessive cleaning; smoking or unauthorized pets; violation of the House Rules; unauthorized guests or events; late check-out; misuse of property or equipment; or other loss or expense reasonably attributable to the Guest or members of the Guest's party.

If costs exceed the amount of the pre-authorization, the Guest remains responsible for the additional amount to the extent permitted by law and the applicable booking agreement.

The timing for released funds to become available is determined by the Guest's financial institution or card issuer.


9. Check-In and Check-Out

Check-in begins at 4:00 p.m. Check-out is no later than 11:00 a.m., unless a different time has been approved in writing.

Unauthorized late check-out may result in a charge of up to $200 where the delay interferes with cleaning, maintenance, operations or the arrival of subsequent guests.

Access instructions and any door codes will be provided only after all required pre-arrival conditions have been completed.


10. House Rules and Guest Information Guide

Guests must comply with the House Rules and applicable instructions contained in The Woodlots Guest Information Guide.

The Guest Information Guide includes important information regarding operation and safe use of the property and its amenities, including the fireplace, hot tub, fire features, propane equipment, waterfront and watercraft.

Guests must not operate equipment or use an amenity if they do not understand the applicable instructions or cannot do so safely.

A failure to comply with material safety requirements, House Rules or these Terms may result in termination of the stay without refund where reasonably necessary to protect persons or property, except where otherwise required by applicable law.


11. Property Access

The Woodlots and its staff, contractors or service providers may access the property when reasonably necessary for maintenance, repair, inspection, hot-tub servicing, landscaping, snow removal, safety, emergency response or protection of the property.

Except in an emergency or where immediate action is reasonably necessary, reasonable efforts will be made to provide advance notice and minimize disruption to Guests.


12. Rural Setting, Wildlife and Natural Conditions

The Woodlots is located in a rural, wooded and waterfront environment. Guests should expect naturally occurring wildlife, insects and changing outdoor conditions.

Wildlife may include deer, porcupines, coyotes, black bears and other animals common to rural Nova Scotia. Seasonal insects may include mosquitoes, blackflies, ticks, spiders and other insects.

The property includes natural terrain and outdoor surfaces such as gravel, stone, wood, pathways, stairs, slopes and waterfront areas. Conditions may change because of rain, snow, ice, wind, temperature, vegetation or other natural causes.

Guests are responsible for exercising care appropriate to the conditions. Wildlife must not be approached, fed or intentionally disturbed.


13. Waterfront and Recreational Amenities

The property may provide access to recreational amenities and equipment including the lake, dock, kayaks, canoe, stand-up paddleboards, bicycles, snowshoes, hot tub, fire pit, fireplaces, fire tables and related equipment.

Use of these amenities carries inherent risks. Guests must follow all posted instructions, applicable laws, safety requirements, Guest Information Guide instructions and any applicable liability waiver.

Transport Canada-approved personal flotation devices must be worn as required by The Woodlots' waterfront rules while using watercraft.

Children must be appropriately supervised around the lake, dock, hot tub, fires and recreational equipment.

Outdoor amenities may be unavailable or restricted because of weather, seasonal conditions, maintenance, water conditions, fire restrictions or other safety considerations. Temporary unavailability of a particular amenity because of reasonable safety, maintenance or weather considerations does not automatically entitle the Guest to a refund, except where otherwise required by applicable law.


14. Fire Safety and Provincial Fire Restrictions

Guests must comply with all applicable provincial and local fire restrictions.

During wildfire-risk season, Guests are responsible for checking the current Nova Scotia BurnSafe restrictions before operating the outdoor fire pit or heating the hot tub using wood.

Where burning is prohibited, Guests must not light any outdoor wood fire regardless of whether equipment is otherwise available for use.

Guests are responsible for fines, penalties or loss caused by their violation of applicable fire restrictions to the extent permitted by law.


15. Hot Tub

Use of the hot tub is subject to the safety and operating requirements contained in the Guest Information Guide and liability waiver.

Guests must not exceed the maximum permitted occupancy or water temperature and must follow all instructions concerning water level, electric heating, wood heating, firebox operation and supervision.

Guests must not alter, drain, disable or interfere with hot-tub mechanical, filtration, heating or safety systems unless expressly instructed to do so.


16. Smoking and Vaping

Smoking and vaping are prohibited inside the cabin.

Guests who smoke or vape outdoors must do so responsibly, comply with fire restrictions and safely dispose of all smoking materials.

Smoking or vaping inside the cabin, or other conduct requiring additional cleaning, deodorizing or remediation, may result in charges reflecting the reasonable cost of remediation or damage.


17. Pets and Service Animals

Pets are not permitted unless expressly approved in advance.

Unauthorized animals may result in additional cleaning, remediation or damage charges and may constitute a material breach of these Terms.

This restriction does not apply where an animal must be accommodated under applicable human-rights, service-dog or other law. Guests requiring an accommodation are encouraged to contact The Woodlots before arrival so appropriate arrangements can be made.


18. Noise, Parties and Events

Guests must respect neighbouring properties and keep outdoor noise to a reasonable level, particularly after 10:00 p.m.

Parties, events, commercial activities and gatherings involving unregistered guests are prohibited unless specifically authorized in writing.

Conduct that creates a safety risk, material disturbance, property damage or unreasonable interference with neighbouring properties may result in termination of the stay.


19. Owner Storage and Restricted Areas

Loft areas, mechanical spaces, owner-storage areas and any other designated restricted areas are not available for guest use. Guests must not attempt to access locked or restricted spaces.


20. Property Condition, Maintenance and Interruptions

The Woodlots will make reasonable efforts to ensure that the property and advertised amenities are available and in normal operating condition.

From time to time, an appliance, utility, amenity or service may become temporarily unavailable because of mechanical failure, power interruption, weather, maintenance or circumstances beyond reasonable control.

Guests must promptly report material problems so that reasonable efforts can be made to correct them.

Nothing in this section limits any rights that cannot lawfully be excluded.


21. Website Information and Errors

The Woodlots makes reasonable efforts to ensure that information, photographs, rates, descriptions and availability shown on its website and authorized booking platforms are accurate.

Occasional errors, omissions or outdated information may occur. The Woodlots may correct genuine errors or inaccuracies to the extent permitted by law.

The Woodlots will not knowingly substitute materially different accommodation from that described in a confirmed reservation without notifying the Guest.


22. Third-Party Platforms and Services

The Woodlots may use or link to third-party services for booking, payment processing, guest verification, mapping, video, manuals or other functions.

Those services are operated independently and may be subject to their own terms and privacy policies.

The Woodlots is not responsible for the operation or content of independent third-party websites or services except to the extent responsibility cannot lawfully be excluded.


23. Personal Information and Privacy

Personal information collected in connection with inquiries, reservations, payment, guest verification and stays is handled in accordance with The Woodlots' Privacy Policy and applicable law.


24. Guest Responsibility for Loss and Damage

The Guest is responsible for loss, damage and reasonable costs caused by the acts or omissions of the Guest, members of the Guest's party, approved visitors, or persons for whom the Guest is legally responsible, subject to applicable law.


25. Limitation of Liability

To the extent permitted by applicable law, Orange Door Properties Inc. is not responsible for loss or damage arising solely from circumstances beyond its reasonable control, including severe weather, utility interruptions, road conditions, wildlife, natural conditions or the acts of unrelated third parties.

Nothing in these Terms excludes or limits liability where such liability cannot legally be excluded or limited.

Use of recreational amenities and activities is additionally governed by any applicable liability waiver.


26. Termination of Stay

The Woodlots may require a Guest or other person to leave the property where reasonably necessary because of serious or repeated violation of these Terms or House Rules; unauthorized occupancy or events; dangerous or unlawful activity; intentional property damage; material interference with neighbours; refusal to comply with important safety requirements; or conduct creating a significant risk to persons or property.

Where a stay is terminated because of the Guest's material breach, no refund will ordinarily be due for the unused portion of the stay, except where otherwise required by applicable law.


27. No Waiver

A failure or delay by The Woodlots to enforce a provision of these Terms does not waive the right to enforce that provision later.

Any exception provided to a Guest applies only to the particular circumstances in which it was granted unless otherwise stated in writing.


28. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed or limited to the minimum extent necessary, and the remaining provisions will continue in effect.


29. Entire Agreement

These Terms, together with the confirmed reservation details, House Rules, Guest Information Guide, applicable liability waiver, Privacy Policy and any other documents expressly incorporated into the reservation, constitute the agreement between The Woodlots and the Guest concerning the reservation and stay.


30. Governing Law

These Terms are governed by the laws of the Province of Nova Scotia and the applicable laws of Canada.

Any mandatory consumer rights or other legal rights that cannot lawfully be excluded remain unaffected.


31. Changes to These Terms

The Terms applicable to a reservation are those presented or incorporated into the booking when the reservation is made, together with any changes subsequently agreed to by the Guest and The Woodlots.

The Woodlots may update the Terms for future reservations from time to time.
